Manner of representation

For submitting declarations of will on behalf of the association in matters falling within ordinary management, incurring obligations within ordinary management, and submitting declarations of will on behalf of the association in matters involving acts exclusively conferring benefits, the Chairperson of the Main Management Board independently, or two Vice-Chairpersons of the Main Management Board acting jointly, holding authorisation from the Chairperson of the Main Management Board, or another person acting under authorisation granted by the Presidium of the Main Management Board in the form of a decision, are authorised. In matters exceeding the scope of ordinary management of funds and property, a decision of the Presidium of the Main Management Board is required. The decision is subject to approval at the next meeting of the Main Management Board. Failure by the Main Management Board to approve the decision of the Presidium of the Main Management Board results in its repeal. Powers of attorney to represent the association before public authorities and local-government authorities at all levels, the public prosecutor's office, law-enforcement authorities, ordinary courts, administrative courts, the Supreme Court and the Constitutional Tribunal are granted by the Chairperson of the Main Management Board. Employment-law acts in relation to employed workers are performed by the Chairperson of the Main Management Board and, in the event of expiry of the Chairperson's mandate, by a person designated by the Presidium of the Main Management Board by way of a decision. The above rules of representation apply accordingly to the representation of local, provincial or school organisations possessing legal personality, whereby the acts provided for: a) the Chairperson of the Main Management Board are performed by the Chairperson of the relevant unit; b) the Vice-Chairperson of the Main Management Board are performed by the Vice-Chairperson of the relevant unit; c) the Presidium of the Main Management Board are performed by the Presidium of the relevant unit; d) the Main Management Board are performed by the relevant local management board, provincial management board or school management board.
